Available Nearby Headquarters Parking

For over a hundred headquarters employees on the parking waiting list, it will be good news that NTEU reports a nearby parking lot at the corner of Marinelli and Nebel is opening up. This lot, ~400 yard away, is managed by a private parking company.  Employees might not be aware of another option. They can park now at spaces available at the Executive Blvd Building and take a NRC shuttle from EBB to the WFN complex while staying on the waiting list for a WFN spot.


NTEU Defends NRC Criminal Investigators – Agency’s Treatment Questionable
February 25, 2010 

Never before has such a small group of 24 agency employees needed help as criminal investigators do now.  The Office of Investigations lead by Director,  Cheryl McCrary [Montgomery] has launched an attack to strip the collective bargaining rights, eliminate union representation, restrict work schedule flexibilities and mandate hundreds of hours of unpaid overtime for which the employees by statute are not required to work. 

First, the agency has proposed to remove criminal investigators from the bargaining unit for which the Union attorneys have formally responded so as to protect their long standing rights.  The Federal Labor Relations Authority (FLRA) will preside over the representation dispute at an upcoming hearing.  The agency’s claims investigator’s work directly affects national security and, if true, would remove their position from the bargaining unit. Read the Union’s statement of position to the FLRA, mapping out similarity with the authorities past decisions so as to retain existing rights and protections investigators have enjoyed since the NRC inception.   

Second, the agency has unnecessarily required investigators to work two extra hours each travel day for, Law Enforcement Availability Pay (LEAP). The statute specifically provides an exclusion for those travel days similar to excluding sick and vacation days from this type of overtime.  NTEU claims each investigator has been required to work well over 100 extra hours each year.  McCrary has failed to resolve the grievance and passed the case on to the EDO.  Read the Union's LEAP-travel-exclusion grievance. 

Finally, the Office of Investigation has restricted investigators from many NEWflex work schedule flexibilities claiming conflict with their requirement to work 2 extra hours each day for their special pay.  NTEU has filed a work schedule-grievance to ensure investigators receive fair an equal benefits as do other NRC employees.  Contact Dale Yeilding in the NTEU Union office with any questions at 301-415-3600.

5-day Agency Closure May Warrant Due Date Extensions 
February 12, 2010

NTEU checked with the EDO-ticketing folks to determine that due date extensions will be processed using the existing system knowing full well this week’s agency closure could be a typical justification.  Employees may want to promptly adjust with their supervisor, their own project deadlines so as not to have the recent agency closure result in missed due dates.  Completing projects ahead of schedule is one of your appraisal rating criteria under “timeliness” that results in an excellent or outstanding rating.

OPM “Delayed Arrival” Condition Is a Mandated Short Day 
February 12, 2010

Again the agency is not completely accurate implementing OPM policy when they place discretion with the supervisor for granting excused absence for a delayed arrival agency operating condition. The OPM delayed arrival condition is similar to an early dismissal except it is for the beginning of the day versus the end of the day. OPM opening the federal government later than normal does so considering conditions and the safety for your commute will improve and directs federal employees to “plan” to arrive the designated number of hours later than normal.

Employees should bookmark the www.OPM.gov web site to check early morning when conditions warrant and utilize the mandated number of excused hours to shorten their workday when a delayed arrival policy is in effect.

OPM Delayed Arrival Policy

When OPM announces a delayed arrival policy, non-emergency employees will be granted excused absence (administrative leave) for the designated number of hours past their normal arrival time. Non-emergency employees are expected to report for work no later than the designated number of hours past their normal arrival time. Employees should plan their commutes so that they arrive for work no more than xx hours later than they would normally arrive…

2010 Pay Raise: 2.42% for Headquarters Employees 

President Obama, last week, signed the executive order to implement the January 2010 pay adjustments for an overall average two percent increase. OPM has posted pay tables that incorporate locality pay providing a higher increase in areas where the cost of living is larger. Salary cap now effects GG 15 - Step 9 NRC employees. Pay rates for GG15-9 and GG15-10 NRC headquarters employees are now the same since they are limited to the rate of Executive Schedule IV by law, 5 U.S.C. 5304 (g)(1). More seriously affected is San Francisco, being in the highest cost of living locality zone which now has 5 steps at the same rate (GS15-6 through GS15-10). Our NTEU National President has presented Congressional testimony for a change to this law.

Security Clearance Financial Reporting - Home Short Sale

A Short-Sale agreement with your bank to sell your home at a lower price than your mortgage balance resulting in the bank accepting less than what is owed is not by itself reportable to the NRC under Management Directive 12.3. Failure to pay on time, missing mortgage payments, or foreclosure may be reportable.

MD12.3, Part 1, (Q)(16): Any financial considerations that indicate an inability or an unwillingness to satisfy debts, not meeting financial obligations, and financial problems linked to gambling, drug abuse, alcoholism, or other issues of a security concern.
Short Sale Real Estate: A short sale is a sale of real estate in which the sale proceeds fall short of the balance owed on the property's loan. It often occurs when a borrower cannot pay the mortgage loan on their property, but the lender decides that selling the property at a moderate loss is better than pressing the current debtor. Both parties consent to the short sale process, because it allows them to avoid foreclosure, which involves hefty fees for the bank and poorer credit report outcomes for the borrower.

NEWflex Becomes Even More Flexible
November 13, 2009 

NTEU negotiated many new extremely flexible provisions into the Collective Bargaining Agreement, Article 6.11 (Flexitime/Flexitour) now called NEWflex (NRC Employees Work schedule Flexibilities) that employees will begin using next pay period. NTEU applauds the majority of Office Directors and Regional Administrators that exercised their discretion for even more options that were made available through Union contract negotiations.

The NEWflex Discretion Chart, posted on the Union website shows which offices/regions permit employees to:

- Earn Credit Hours on Saturdays

- Work past 8pm till 11pm regularly - combine with telework to work a few nights at home

- Work regularly on Saturdays

- Reduce core hours

Lazy Supervisors Generate Automatic Appraisals
October 23, 2009

Employees may want to compare their appraisal to the web automatically generated appraisal below to determine if their supervisor took the easy way out to not have to write any actual appraisal evaluation. Next year a new provision of the Collective Bargaining Agreement (CGA) goes into effect which will make the lazy supervisors actually evaluate employees.

CBA, 25.7 Supporting Individual Element Ratings 
n addition to indicating the rating, the supervisor shall write a brief narrative for each critical element, rating performance against the written Fully Successful standard. When performance exceeds or does not meet the Fully Successful standard, justification should be included to clearly and explicitly justify the assignment or a rating above or below the Fully Successful level.

NTEU Troubled by Rise in FEHBP Premiums for 2010 
September 30, 2009

The average 8.8 percent increase in 2010 health care premiums for the eight million federal employees and retirees covered under the Federal Employees Health Benefits Program (FEHBP) indicates the Office of Personnel Management (OPM) can do a better job in leveraging the weight of the largest health plan in the United States to keep costs down. OPM again uses money from reserves to keep the increases down.

The employee share of the cost for those covered by the FEHBP’s most popular health care program—the Blue Cross/Blue Shield standard plan—will rise by 15 percent for self-only coverage and 12 percent for family coverage. Roughly 60 percent of FEHBP’s participants are covered by the Blue Cross/Blue Shield standard or basic plans. This is an enormous increase that erodes federal employees’ standard of living. Affordable health care is essential in attracting and retaining a stable, high-quality workforce.

What is NTEU doing besides issuing a National press release?

1) NTEU has advocated a plan that would allow the FEHBP to use the Federal Supply Schedule to purchase drugs—the so-called ‘statutory pricing,’ which is permitted by law for the Veterans’ Administration, the Defense Department, Coast Guard and Public Health Service—which could reduce prescription drug costs by as much as 50 percent off the average wholesale price. NTEU made the argument for its position at a Washington forum on improving FEHBP’s drug benefit organized by Rep. Stephen Lynch (D-Mass.,) chairman of the House Oversight and Government Reform Subcommittee on the Federal Workforce.

2) NTEU supports legislation for an increase in the government’s share of FEHBP premiums from an average of 72 percent to an average of 80 percent—a figure that is common among private sector employers.

3) NTEU is opposing an amendment to health care legislation that would open up the Federal Employees Health Benefits Program (FEHBP) to members of the public who meet certain qualifications. While NTEU strongly support efforts to provide health care coverage to all Americans, federal employees and retirees should not be singled out to subsidize that effort.

4) NTEU National President Kelley has long argued that OPM has not done enough to use the marketing clout created by FEHBP’s status as the largest employer-sponsored plan to rein in costs. A health insurance program means little to the people it is supposed to cover if it is unaffordable.

How does your 2008 Appraisal Rating match up to other Offices?

Annually, for the past 7 years, NTEU has provided employees with the percentage of Outstanding, Excellent and Fully Successful appraisal ratings by office/region in a statistical chart. The agency has finally made available to NTEU, last year’s appraisal information which is now posted on the Union’s “Appraisal Tips” webpage.

Significant Movers: You’ll find ADM, HR and OI has dropped more than 10 points in the office scoring between 2007 and 2008. NSIR and NRO have dropped 6 positions in the rankings. OE has gained 21 points and moved above 8 other offices. Region IV is the first region to be scored “Green”. 

Maybe the agency’s downward trend to lower appraisal ratings may be finally reversing.

Be advised that only 11% of employees are rated Fully Successful. Besides affecting your award amount, when applying for a promotion, 89% of the other applicants may have a leg-up with an O or E rating, since the appraisal is part of your application package. Learn about “close-out” appraisals in the new Collective Bargaining Agreement (Article 25.5) after your next transfer or promotion. With frequent supervisory changes, remember to call for written performance feed back from your departing supervisor. Don’t wait another year for a rating if you have not worked 120 days in your new position as of Oct 1st. Get rated on your 120th day to keep your “annual rating of record” current..

Collective Bargaining Disputes in Federal Mediation

After 3 full days of bargaining under the guidance of a federal mediator from the Federal Mediation and Conciliation Service (FMCS), the agency and the Union have reduced their disputes from 72 to 22 issues.  Both parties are making concessions and removing or resolving issues to reach an agreement.  The remaining unresolved issues involve: fine tuning new work schedule flexibilities, accurately defining eligibility to move to an improved workstation, rating applications for a small number of candidates, fairly linking awards to performance appraisals and guaranteeing a grievance decision through a process free from technicalities to prevent the agency from terminating an employee appeal based upon a missed deadline.

Federal Student Loan Forgiveness
June 26. 2009 

NTEU backed the new Public Service Loan Forgiveness program when it was passed by Congress as part of the College Cost Reduction and Access Act of 2007.  Last year, the regulation process to implement the new law took place at the Department of Education.  The program allows the forgiveness of the balance on qualifying federal student loans after a recipient makes payments for ten years, beginning in October, 2007.  The first cancellation of student loans will not take place until 2017 for full-time employees in public service, including qualifying federal employees.  But for those with high debt, this is a very positive option.  While the actual loan forgiveness is down the road, those of you with high debt, may wish to investigate this program to see if your loans qualify, or if loan consolidation avenues are available for you.  In general, the student loans must be a part of the government’s Direct Loan Program, or be eligible for consolidation.  The linked fact sheet and financial aid website has some useful information.

Finally, I want to emphasize that this new program is separate from the existing student loan reimbursement program that is currently available at the NRC under Article 56 of the Collective Bargaining Agreement which may provide up to $10,000 a year for loan repayment with a lifetime maximum of $60,000.  Contact Dale Yeilding in the Union office (301-415-3600) with any questions or visit the links above.


NTEU Negotiates Longer eTravel Help Desk Hours

Last month, the eTravel Helpdesk hours were extended to 7 p.m., eastern time, in accordance with the agreement NTEU negotiated with NRC for implementation of eTravel. Having the Helpdesk available until 7 p.m., eastern time, was to make assistance available to those working late and to better accommodate employees in the western time zones. The Helpdesk availability is just one of several provisions the Union identified for the implementation of eTravel. Agency Settles with Union on Email Communications 
June 25, 2009

The Union filed for Arbitration to resolve two cases involving over a dozen instances of agency refusal to issue Union email announcements to employees.  Agency issued Union announcements are required by the Collective Bargaining Agreement and had previously been issued for over a decade without disagreement.  A settlement agreement was reached just before the scheduled hearing.  NTEU will now be provided a special email-announcement account to distribute Union announcements directly to bargaining unit employees without intervention by management. 

Prior to the settlement agreement, the contract permitted the agency to comment on announcements.  Regardless of comment resolution, the agency was obligated by the contract to issue Union announcements to all employees including managers.  The settlement agreement eliminates managers and non-bargaining unit employees from Union announcement distribution.  Managers will now only receive NTEU information if their bargaining unit staff is so inclined to share it.  The agency will maintain for the Union an up-to-date announcement distribution list of bargaining unit employees, accounting for new hires, retirements and job classification changes.  The settlement agreement included a change to the Collective Bargaining Agreement.  This settlement is a victory for the Union resulting in the right to unfettered communication with the over 3000 bargaining unit employees that we represent.

Proposal to Lower Federal Retirement Benefits

John Boehner's letter to the President and actual proposal 

On June 4, 2009, the Republican leadership in the House submitted a so-called deficit reduction proposal to the President changing the federal retirement systems to lower benefits.  First, they would change employees’ annuities to a calculation based on a “high-five” average salary, instead of the current “high three.”  According to the nonpartisan Congressional Budget Office (CBO), this would reduce a CSRS-covered retiree’s pension by approximately $1,250 a year.  Second, for FERS retirees who are under age 62, it would eliminate the payment that is available up until the recipient becomes eligible for social security at age 62.  Not only does this change the retirement rules in midstream, but it is unfair to those federal employees like public safety officers who must retire prior to age 62.

Collective Bargaining Update on Employee Benefit Roll-Back
May 12, 2009

 After 7 weeks of bargaining since the parties exchanged proposals last year in November, 102 issues remain in dispute.  The Union has listed these issues on the NTEU website.  A federal mediator from the Federal Mediation and Conciliation Service (FMCS) has been contacted to assist in resolving the disputes.  If agreement is not obtained, the disputed issues would be resolved by the Federal Service Impasses Panel sometime next year.  Contact Dale Yeilding in the NTEU Union office, 301-415-3600 with any questions about the Union's firm stand to protect employee benefits.

Employee Benefit Roll-Backs - Management proposes to:

- restrict project-based telework eligibility to the same positions as fixed-schedule telework
- exclude 6-month temporary promotions from competitive procedures providing an unfair advantage to select employees
- reduce vacancy postings from 16 days to 5 days restricting opportunities for employees on travel or taking vacations
- permit an office to promote from only within their own office, limiting opportunities for others
- eliminate rating panels and permit selection of a minimally qualified applicant from a group of 10
- only need one member of the rating panel to have knowledge of the position being filled
- expand the best qualified list to include those just minimally qualified to give the selecting official a larger pool
- eliminate written documentation for minimally successful performance
- standardize workstation improvement criteria to limit employee moves

The NRC Chairman was interviewed by the Federal Diary Columnist Joe Davidson about the NRC's top ranking as the best place to work in the federal government.  When asked about the ongoing collective bargaining involving 144 disputed issues, the Chairman responded:  "The issues we've had with the Union are small".   

Some of these small issues involve, the Union firm stand against the agency's assault on telework, protection of  employee's pay structure and expansion of flexible work schedules. NRC employees realize that the Union has been a major contributor, through traditional bargaining, to change the face of the agency over the past three decades to make it the best place to work.  The Chairman advises other agency's aspiring for NRC's top ranking with three reasons:  Communication, Communication, Communication yet the agency reverses course by proposing to prohibit the Union's use of email announcements to communicate with employees.  As the Chairman boasts communication as a significant contributor to the agency's top ranking, he may want to improve his own communication with the Union to better understand the magnitude of current employee issues that the Union is charged to protect.

Question:
  Although the NRC is the top scorer among federal agencies, the union has issues with it.  The National Treasury Employees Union which is in negotiations with the NRC, says 144 significant issues remain in dispute after a lengthy bargaining period.  The Union says it objects to agency proposals that would restrict telework, eliminate the Union's use of email to communicate with employees and strengthen a supervisor's ability to deny a worker's choice of off days, among many other items.

Chairman Klein Answer: Unions typically look at issues for which they can claim representation for the masses.  We have, I think, an excellent relationship with our employees.  The issues we've had with the union have been small.  We try to meet the needs of our employees.  We do have flexible work schedules, we do let people telecommute, we have a day-care center for families, we have parking that we subsidize.  You want people to feel happy to come to work rather than feel they have to come to work, and I think, overall, the agency does a good job at that.

With many of its current proposals, the Agency proposes to roll back employee benefits to 1977 before NTEU became the exclusive representative.  Back then, employee rights were in a sorry state, with existing promotion procedures essentially non-existent resulting in managers making selections without rating panels, everyone working 8:15am-5pm, and the agency being run like a military boot camp.  We've come a long way since then to become the best place to work in the federal government, even though management fought the Union's proposals every step of the way.  NTEU does not understand why the agency wishes to turn back the clock but you can be assured the Union will be taking a tough stand to protect what we fought so hard to achieve.

 The good news is that NTEU and the agency have agreed to more than half of the 57 articles of the Collective Bargaining Agreement during the past few months involving 5 full weeks of bargaining.  The bad news is 144 significant issues remain in dispute.  NTEU has assembled a complete list on the Dispute Chart and requests your feedback.

 SOME AGENCY PROPOSALS: 

  - an agency wide change to "grade" as the sole criteria for workstation selection while many offices currently use different formulas to include seniority

   - changes to project-based telework, restricting participation to only those eligible for fixed schedule telework and requiring project-based registration forms which are now not required for this existing paperless program

   - changes that would strengthen the supervisors ability to deny the employee's choice for a CWS day off

   - increase the number of reasons for a manager to deny credit hour time off

   - eliminate the employee 60-day notice for denial of a within-grade (step) pay increase

   - extend temporary promotions without competition allowing select candidates to gain valuable experience

   - eliminate crediting plans, rating panels for 10 or fewer applicants and redefine the best qualified list to management's discretion

   - eliminate employee appeal for counseling, thus permitting future escalated discipline to proceed unchecked

   - eliminate the informal problem solving program forcing employees to file formal grievances immediately

  - eliminate the Union's use of email to communicate with employees

   - and many, many, more employee benefit roll backs…
