The NRC harassment policy is documented in Yellow Announcement 2007-004. NTEU and the agency negotiated this policy and signed a Memorandum of Understanding (MOU) on November 27, 2006. The MOU includes the use of an Employee notification form below. This form documents many rights the employee would be waiving by processing the harassment claim through this agency informal harassment process. The bottom of the form also provides important feed back to the employee, dealing with substantiation of their claim.

Employees seeking resolution to employment concerns via the harassment policy and procedures will be informed, in writing, of the right and applicable deadline to file an EEO complaint or a grievance, separate and apart from any provisions of this policy. Employees seeking resolution to employment concerns via this policy and procedures will be informed, in writing, whether their complaint is/was covered under this policy.

Policy and Procedure
for Preventing and Eliminating Harassing Conduct in the Workplace
Employee Notice of Rights and Associated Deadlines
Filing a report of harassing conduct under this Policy does not satisfy the requirements associated with any complaint, appeal or other statutory or regulatory process that may apply, nor does it delay the time limits for initiating those procedures.
Nothing in this Policy and Procedure affects the right of an individual to contact the OIG regarding alleged harassing behavior.
Nothing in this Policy and Procedure affects the right of an individual to participate in the EEO complaint process, within 45 calendar days of the event out of which the complaint arose, or within 45 calendar days after the date the complainant should have been aware of the matter out of which the complaint arose.
Nothing in this Policy and Procedure affects the right of an individual
to file an appeal with the MSPB within 30 calendar days.
Nothing in this Policy and Procedure affects the right of an individual
to file, an Agency administrative grievance within 10 workdays after the
occurrence of the matter out of which the grievance arose, or within 10
workdays after the date the aggrieved should have been aware of the
occurrence of the matter out of which the grievance arose.
Nothing in this Policy and Procedure affects the right of a bargaining
unit employee to initiate a grievance under the NRC-NTEU CBA within
15
workdays after the occurrence of the matter out of which the grievance
arose, or within 15 workdays after the date the aggrieved should reasonably
have been aware of the occurrence of the matter out of which the grievance
arose.
