NTEU Telework Information Request

NTEU requests the list of the specific 2500 NRC positions eligible for work-at-home as reported in the May 30, 2007 letter to Congress (Kline/Waxman).

The agency provided NTEU a list of approximately 1000-eligible positions for work-at-home that were identified in separate Office Director and
Regional Administrator memorandums dated June/July 2001.  NTEU has recently become aware that the Agency has notified Congress that 2500
positions are now available for work-at-home.  NTEU applauds and supports the Agency's expansion of this employee flexible work benefit.  
NTEU understands that denial or termination of the program based upon position eligibility is not grievable. Thus, NTEU must maintain an
accurate list of eligible positions as it has since 2001 to properly advise and represent employees when they seek NTEU assistance with
work-at-home issues.  NTEU, per article 54.9 of the Collective Bargaining Agreement (CBA) , has the ability to "request a review of a
decision to exclude a class of positions form the fixed schedule Flexiplace Program by the Director, Office of Human Resources."  This
ability to request a review is another reason for NTEU's need to maintain an accurate list of eligible positions for work-at-home in the
Union office.  
The Congressional letter was available to NTEU the week of June 8, 2007, and basis for this information request under CBA, Article 45. 
NTEU reserves the right for a review or institutional grievance based upon the information received and requests associated time frames to be
appropriately adjusted until this information is received per Article 45.6.4.
