Memorandum for: ALL OFFICE AND REGIONAL (LOCAL) PARTNERSHIP COMMITTEES

As you know, President Bush issued Executive Order (E.O.) 13203 on February 17, 2001 revoking E.O. 12871 (issued in 1993) which mandated agencies establish partnerships with their labor organizations. E.O. 13203 also revoked any orders, rules, regulations, guidelines, or policies implementing or enforcing E.O. 12871. In April of last year, the Agency Labor Management Partnership Committee (ALMPC) decided to maintain a partnership relationship and issued interim guidance based on E.O. 13203. The most significant change for partnership committees was the discontinuing of consensus discussions on the numbers, types, and grades of bargaining unit positions within organizations.  Also at that time, consistent with the new E.O., it was decided to review and revise the NTEU-NRC Charter for partnership and the ALMPC guidance issued to local partnerships.

Both of these tasks have been completed. The new NTEU-NRC Partnership Charter was rewritten and signed on October 16, 2001. The previous guidance documents (there were five) issued to local partnership committees have also been reviewed. The ALMPC has revoked guidance document #1-"Reorganizations" and guidance document #5-"Numbers, Types, and Grades." Guidance documents #'s 2,3, and 4 have been modified slightly, and are re-issued as attachments to this notice.

During the review of the prior guidance, the ALMPC concluded that the guidance pertaining to "reorganizations" was overly prescriptive and did not contribute to the efficiency of the process. Although this guidance document has been revoked, Reorganizations are still subject to bi-lateral discussion (implementation issues are still appropriate topics for partnership).  In addition, constructive feedback on reorganizing is useful, and is encouraged.

With regards to the "numbers, types, and grades" guidance, local committees are no longer required to partner these matters to consensus.  However, they may continue to discuss staffing plans and related issues.

SUBJECT: AGENCY LABOR-MANAGEMENT PARTNERSHIP COMMITTEE (ALMPC) MEMORANDUM #1 - GUIDANCE AND INSTRUCTION

ALMPC Oversight of Local Labor-Management Partnership
Committees (LMPC)

As part of the ALMPC's oversight responsibilities, members (or designees) of the ALMPC may attend any local committee meetings to better assess the direction of LMPCs and to serve as a resource to that committee. Designees may include Labor Relations staff from the Office of Human Resources, Labor Attorneys from the Office of the General Counsel, and NTEU Stewards. Normally, the ALMPC member will advise the LMPC of his/her plans to attend a meeting.

ALMPC Oversight of Local Labor-Management Partnership
Committees (LMPC)

The ALMPC may review any LMPC agenda or agreement to identify issues having an agency-wide impact which may significantly impact employees in other offices or regions. When such issues are identified, the ALMPC will provide guidance to the LMPC on a case-by-case basis.  In addition to this guidance role, the ALMPC may modify or suspend an LMPC agreement if the ALMPC believes that an agreement contains provisions which are not in the NRC's overall interest.

SUBJECT: AGENCY LABOR-MANAGEMENT PARTNERSHIP COMMITTEE (ALMPC) MEMORANDUM #3 - GUIDANCE AND INSTRUCTION

Employee Communication with Partnership Committee Members

In order to clarify the communication channels relative to partnership, the following guidance is provided. This guidance should be disseminated to employees in your office/region and appropriate mechanisms should be established in each office/region to facilitate this information flow.

In addition to the agency level partnership committee (ALMPC), the agency has established a number of office and regional partnership committees. These committees encourage open communications with employees through dissemination of meeting agendas and minutes, as well as personal interaction with committee members. The ALMPC has received the following questions from employees concerning lines of communication/interactions with partnership committee members:

1) Must bargaining unit employees communicate/interact only with union representatives?

2) Must non-bargaining unit employees communicate/interact only with management representatives?

With regard to any or all partnership committees, the ALMPC recommends that employee comments be submitted, via a committee E-mail address, to all members of partnership committees simultaneously so that each member has knowledge of the same information.  Each committee should establish such an E-mail address and provide it to their employees. This is the preferred method; however, this does not preclude one-on-one discussion with any individual committee members.
